These businesses may use technology provided by Candid Color Systems, Inc. What Is Biometric Data?<\/h2>\n        \n                    <div class=\"item__content\">\n                <p>\u201cBiometric data\u201d generally refers to data derived from unique biological characteristics, such as facial geometry, that can be used to identify an individual.<\/p>\n<p>For purposes of this policy, biometric data may include:<\/p>\n<p><strong>Biometric Identifier<\/strong>\u00a0means a retina or iris scan, fingerprint, voiceprint, or scan of face geometry.<\/p>\n<p><strong>Biometric Information<\/strong>\u00a0means any information based on a biometric identifier that is used to identify an individual.<\/p>\n<p>Biometric identifiers do not include:<\/p>\n<ul>\n<li>Photographs<\/li>\n<li>Video recordings<\/li>\n<li>Physical descriptions<\/li>\n<li>Demographic data<\/li>\n<li>Information derived from photographs unless used to create a facial template for identification<\/li>\n<\/ul>\n            <\/div>\n        \n            <\/div>\n<\/div>\n\n\n\n                                            <\/div>\n                                                                                                    <div class=\"customContent__row\">\n                    \n                                                <div class=\"customContent__item customContent__item--spacer customContent__item--first customContent__item--last \" data-width=\"100\" style=\"height:15px;\"><\/div>\n                                            <\/div>\n                                                                                                    <div class=\"customContent__row\">\n                    \n                                                \n<div class=\"customContent__item customContent__item--richText customContent__item--first customContent__item--last \" data-width=\"100\" data-align-x=\"left\" data-align-y=\"top\">\n    <div class=\"item__inner\">\n                    <h2>4. Roles and Responsibilities<\/h2>\n        \n                    <div class=\"item__content\">\n                <p>Because TSS Photography operates through independent franchisees supported by CCS technology, responsibilities are divided as follows:<\/p>\n<ul>\n<li><strong>Franchisees \/ Photographers<\/strong>\n<ul>\n<li>Capture images<\/li>\n<li>Interact with customers<\/li>\n<li>Provide required notices and obtain consent where required by law<\/li>\n<\/ul>\n<\/li>\n<li><strong>Candid Color Systems, Inc. (CCS)<\/strong>\n<ul>\n<li>Provides the platform and technology<\/li>\n<li>Processes biometric data solely to deliver services such as image matching or search<\/li>\n<li>Does not control the operations of independent franchisees<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Franchisees and other CCS customers are responsible for complying with applicable biometric privacy laws.<\/p>\n            <\/div>\n        \n            <\/div>\n<\/div>\n\n\n\n                                            <\/div>\n                                                                                                    <div class=\"customContent__row\">\n                    \n                                                <div class=\"customContent__item customContent__item--spacer customContent__item--first customContent__item--last \" data-width=\"100\" style=\"height:15px;\"><\/div>\n                                            <\/div>\n                                                                                                    <div class=\"customContent__row\">\n                    \n                                                \n<div class=\"customContent__item customContent__item--richText customContent__item--first customContent__item--last \" data-width=\"100\" data-align-x=\"left\" data-align-y=\"top\">\n    <div class=\"item__inner\">\n                    <h2>6. Consent and Notice<\/h2>\n        \n                    <div class=\"item__content\">\n                <p>Where required by law, biometric data will only be collected or processed after appropriate notice and consent have been obtained.<\/p>\n<p>In the TSS Photography context:<\/p>\n<ul>\n<li>The local franchisee or photographer is responsible for informing individuals about the use of biometric-enabled features<\/li>\n<li>Consent must be obtained before biometric data is collected or used where required by applicable law<\/li>\n<li>CCS relies on its customers (including franchisees) to confirm that such consent has been obtained<\/li>\n<\/ul>\n<p>Facial recognition features are activated only when:<\/p>\n<ol>\n<li>The photographer or studio affirmatively enables the feature; and<\/li>\n<li>Required consents are obtained where applicable under law.<\/li>\n<\/ol>\n<p>Where required by law, written consent must be obtained from the individual (or parent\/guardian for minors) before biometric data is collected.<\/p>\n<p>Photographers and franchisees are responsible for obtaining legally required releases and consents from their subjects.<\/p>\n<p>By enabling facial recognition, the franchisee represents and warrants that it has obtained all legally required consents.<\/p>\n            <\/div>\n        \n            <\/div>\n<\/div>\n\n\n\n                                            <\/div>\n                                                                                                    <div class=\"customContent__row\">\n                    \n                                                <div class=\"customContent__item customContent__item--spacer customContent__item--first customContent__item--last \" data-width=\"100\" style=\"height:15px;\"><\/div>\n                                            <\/div>\n                                                                                                    <div class=\"customContent__row\">\n                    \n                                                \n<div class=\"customContent__item customContent__item--richText customContent__item--first customContent__item--last \" data-width=\"100\" data-align-x=\"left\" data-align-y=\"top\">\n    <div class=\"item__inner\">\n                    <h2>7. How Biometric Data Is Used<\/h2>\n        \n                    <div class=\"item__content\">\n                <p>Biometric data is used solely to support specific functionality, such as:<\/p>\n<ul>\n<li>Helping users locate their images more efficiently<\/li>\n<li>Improving image organization and delivery<\/li>\n<\/ul>\n<p>Biometric data is not sold and is not used for unrelated purposes such as advertising.<\/p>\n            <\/div>\n        \n            <\/div>\n<\/div>\n\n\n\n                                            <\/div>\n                                                                                                    <div class=\"customContent__row\">\n                    \n                                                <div class=\"customContent__item customContent__item--spacer customContent__item--first customContent__item--last \" data-width=\"100\" style=\"height:15px;\"><\/div>\n                                            <\/div>\n                                                                                                    <div class=\"customContent__row\">\n                    \n                                                \n<div class=\"customContent__item customContent__item--richText customContent__item--first customContent__item--last \" data-width=\"100\" data-align-x=\"left\" data-align-y=\"top\">\n    <div class=\"item__inner\">\n                    <h2>8. Data Retention and Deletion<\/h2>\n        \n                    <div class=\"item__content\">\n                <p>Biometric data is retained only for the shortest period necessary to fulfill the purpose of collection.<\/p>\n<p>Biometric data will be permanently deleted when the earliest of the following occurs:<\/p>\n<ol>\n<li>The user requests deletion in writing.<\/li>\n<li>The associated account or gallery is deleted.<\/li>\n<li>The facial recognition feature is disabled.<\/li>\n<li>Three (3) years after the individual\u2019s last interaction with the platform; or<\/li>\n<li>As otherwise required by applicable law.<\/li>\n<\/ol>\n<p>Deletion is permanent and irreversible.<\/p>\n            <\/div>\n        \n            <\/div>\n<\/div>\n\n\n\n                                            <\/div>\n                                                                                                    <div class=\"customContent__row\">\n                    \n                                                <div class=\"customContent__item customContent__item--spacer customContent__item--first customContent__item--last \" data-width=\"100\" style=\"height:15px;\"><\/div>\n                                            <\/div>\n                                                                                                    <div class=\"customContent__row\">\n                    \n                                                \n<div class=\"customContent__item customContent__item--richText customContent__item--first customContent__item--last \" data-width=\"100\" data-align-x=\"left\" data-align-y=\"top\">\n    <div class=\"item__inner\">\n                    <h2>9. Data Sharing<\/h2>\n        \n                    <div class=\"item__content\">\n                <p>Biometric data may be shared only as necessary to provide services, including:<\/p>\n<ul>\n<li>Between franchisees and CCS for processing and fulfillment<\/li>\n<li>With service providers acting on behalf of CCS under appropriate safeguards<\/li>\n<\/ul>\n<p>Biometric data is not disclosed to third parties except as required to provide services or comply with legal obligations.<\/p>\n<p>Candid does not:<\/p>\n<ul>\n<li>Sell biometric identifiers<\/li>\n<li>Profit from biometric data<\/li>\n<li>Use biometric data for advertising<\/li>\n<li>Use biometric data for cross-platform tracking<\/li>\n<\/ul>\n<p>Biometric data is used solely to provide requested facial recognition functionality.<\/p>\n            <\/div>\n        \n            <\/div>\n<\/div>\n\n\n\n                                            <\/div>\n                                                                                                    <div class=\"customContent__row\">\n                    \n                                                <div class=\"customContent__item customContent__item--spacer customContent__item--first customContent__item--last \" data-width=\"100\" style=\"height:15px;\"><\/div>\n                                            <\/div>\n                                                                                                    <div class=\"customContent__row\">\n                    \n                                                \n<div class=\"customContent__item customContent__item--richText customContent__item--first customContent__item--last \" data-width=\"100\" data-align-x=\"left\" data-align-y=\"top\">\n    <div class=\"item__inner\">\n                    <h2>10. Your Choices<\/h2>\n        \n                    <div class=\"item__content\">\n                <p>Where biometric-enabled features are offered, individuals may have the option to:<\/p>\n<ul>\n<li>Decline to use face search or similar features<\/li>\n<li>Request removal of images or associated data, where applicable<\/li>\n<\/ul>\n<p>Requests may be directed to the local TSS Photography business or through the contact information below.<\/p>\n<p>Individuals may:<\/p>\n<ul>\n<li>Request confirmation of whether biometric data is being processed<\/li>\n<li>Request deletion of biometric data<\/li>\n<li>Withdraw consent (where applicable)<\/li>\n<li>Disable facial recognition (through the studio or account holder)<\/li>\n<\/ul>\n<p>Requests may be submitted to:<\/p>\n<p><strong>ccssupport@candid.com<\/strong><\/p>\n<p>We may require identity verification before fulfilling requests.<\/p>\n<p>Where facial recognition is used for minors (e.g., school photography, youth sports):<\/p>\n<ul>\n<li>Photographers\/studios must obtain parental or guardian consent where required by law.<\/li>\n<li>We rely on photographers and studios to ensure lawful collection.<\/li>\n<\/ul>\n<p>We will delete biometric data of minors upon verified request from a parent or guardian.<\/p>\n            <\/div>\n        \n            <\/div>\n<\/div>\n\n\n\n                                            <\/div>\n                                                                                                    <div class=\"customContent__row\">\n                    \n                                                <div class=\"customContent__item customContent__item--spacer customContent__item--first customContent__item--last \" data-width=\"100\" style=\"height:15px;\"><\/div>\n                                            <\/div>\n                                                                                                    <div class=\"customContent__row\">\n                    \n                                                \n<div class=\"customContent__item customContent__item--richText customContent__item--first customContent__item--last \" data-width=\"100\" data-align-x=\"left\" data-align-y=\"top\">\n    <div class=\"item__inner\">\n                    <h2>11.
